This obligation applies to all EU Member States under Article 18 of the EU Charter of Fundamental Rights. Yet, the recent and increasing attempts by the EU and its Member States to evade their asylum responsibilities by outsourcing asylum processing and refugee protection risk undermining the international protection system. The undersigned human rights and humanitarian organisations are alarmed by these developments and urge the EU and its Member States to safeguard the right to territorial asylum in Europe.<\/p><p style=\"box-sizing: inherit; margin: 24px 0px 0px; padding: 0px; overflow-wrap: break-word; color: #000000; font-family: 'Amnesty Trade Gothic', sans-serif;\">Discussions on the externalisation of asylum are not new, and have been consistently criticised, contested and rejected over the years. The\u00a0<a style=\"box-sizing: inherit; text-decoration-line: underline; color: #000000; transition: color 0.3s ease-in-out 0s; text-decoration-skip-ink: auto; font-weight: bold;\" href=\"https:\/\/www.statewatch.org\/media\/documents\/news\/2018\/jul\/eu-council-com-paper-disembarkation-options.pdf\">European Commission<\/a>\u00a0itself ruled out the legal feasibility of such models in 2018, describing them as \u201cneither desirable nor feasible\u201d. Global protection needs are higher than ever and low and middle income countries are hosting\u00a0<a style=\"box-sizing: inherit; text-decoration-line: underline; color: #000000; transition: color 0.3s ease-in-out 0s; text-decoration-skip-ink: auto; font-weight: bold;\" href=\"https:\/\/www.unhcr.org\/about-unhcr\/who-we-are\/figures-glance\">75%<\/a>\u00a0of the world\u2019s refugees. Despite this, there has been a recent upsurge in proposals to shift the processing of asylum applications, or indeed the responsibility for providing refugee protection, to non-EU countries.<\/p><p style=\"box-sizing: inherit; margin: 24px 0px 0px; padding: 0px; overflow-wrap: break-word; color: #000000; font-family: 'Amnesty Trade Gothic', sans-serif;\">Italy, for instance, is currently seeking to process asylum applications of certain groups of asylum seekers outside of its territory, from detention in Albania \u2013 which risks leading to prolonged,\u00a0<a style=\"box-sizing: inherit; text-decoration-line: underline; color: #000000; transition: color 0.3s ease-in-out 0s; text-decoration-skip-ink: auto; font-weight: bold;\" href=\"https:\/\/www.amnesty.org\/en\/documents\/EUR30\/7587\/2024\/en\/\">automatic detention<\/a>, a denial of access to fair asylum procedures with necessary procedural guarantees, and delayed disembarkation<br style=\"box-sizing: inherit;\" \/>for people rescued or intercepted at sea.\u00a0<a style=\"box-sizing: inherit; text-decoration-line: underline; color: #000000; transition: color 0.3s ease-in-out 0s; text-decoration-skip-ink: auto; font-weight: bold;\" href=\"https:\/\/www.dr.dk\/nyheder\/politik\/danmark-samler-over-halvdelen-af-eu-landene-i-faelles-opraab-vil-have-modtagecentre\">Others<\/a>, such as\u00a0<a style=\"box-sizing: inherit; text-decoration-line: underline; color: #000000; transition: color 0.3s ease-in-out 0s; text-decoration-skip-ink: auto; font-weight: bold;\" href=\"https:\/\/www.clingendael.org\/sites\/default\/files\/2024-02\/Clingendael_Report_In_Search_of_Control_Denmark.pdf\">Denmark<\/a>\u00a0and\u00a0<a style=\"box-sizing: inherit; text-decoration-line: underline; color: #000000; transition: color 0.3s ease-in-out 0s; text-decoration-skip-ink: auto; font-weight: bold;\" href=\"https:\/\/www.amnesty.de\/fluechtlinge-schutzsuchende-auslagerung-asylverfahren\">Germany<\/a>, are assessing the feasibility of this type of arrangement.\u00a0<a style=\"box-sizing: inherit; text-decoration-line: underline; color: #000000; transition: color 0.3s ease-in-out 0s; text-decoration-skip-ink: auto; font-weight: bold;\" href=\"https:\/\/uim.dk\/media\/12635\/joint-letter-to-the-european-commission-on-new-solutions-to-address-irregular-migration-to-europe.pdf\">15 EU Member States<\/a>\u00a0and some political groups have endorsed similar shortsighted measures to shift asylum processing outside EU territory and encouraged the European Commission to explore ways to facilitate this through further legislative reform, including through a watered down \u2018safe third country\u2019<br style=\"box-sizing: inherit;\" \/>concept.<\/p><p style=\"box-sizing: inherit; margin: 24px 0px 0px; padding: 0px; overflow-wrap: break-word; color: #000000; font-family: 'Amnesty Trade Gothic', sans-serif;\">These attempts must be seen in the context of parallel containment efforts that seek to stem departures and prevent the arrival of asylum seekers to EU territory through partnership agreements with third countries, with little to no attention to the human rights records of those authorities. Over the past years, the European<br style=\"box-sizing: inherit;\" \/>Commission has continued bypassing public or parliamentary scrutiny and EU legislative frameworks as it concludes ever more controversial and untransparent deals with non-EU countries, throwing at them large sums of money with no genuine human rights safeguards or monitoring mechanisms, with the aim to contain and deter migration and onwards movement of refugees toward the EU at seemingly any human cost.<\/p><p style=\"box-sizing: inherit; margin: 24px 0px 0px; padding: 0px; overflow-wrap: break-word; color: #000000; font-family: 'Amnesty Trade Gothic', sans-serif;\"><span style=\"box-sizing: inherit; font-weight: bolder;\">Human costs of externalisation<\/span><\/p><p style=\"box-sizing: inherit; margin: 24px 0px 0px; padding: 0px; overflow-wrap: break-word; color: #000000; font-family: 'Amnesty Trade Gothic', sans-serif;\"><span style=\"font-weight: var( --e-global-typography-text-font-weight ); text-align: var(--text-align);\">Attempts to outsource asylum to third countries are a manifestation of states\u2019 flagrant shirking of their legal\u00a0<\/span><span style=\"font-weight: var( --e-global-typography-text-font-weight ); text-align: var(--text-align);\">responsibility for people in need of protection. Outsourcing asylum processing and protection to third\u00a0<\/span><span style=\"font-weight: var( --e-global-typography-text-font-weight ); text-align: var(--text-align);\">countries who cannot provide effective protection or are already disproportionately hosting refugees, is\u00a0<\/span><span style=\"font-weight: var( --e-global-typography-text-font-weight ); text-align: var(--text-align);\">inconsistent with the objective and spirit of the Refugee Convention. It also obfuscates\u00a0<\/span><a style=\"text-align: var(--text-align); background-color: #fafafa; box-sizing: inherit; text-decoration-line: underline; color: #000000; transition: color 0.3s ease-in-out 0s; text-decoration-skip-ink: auto; font-weight: bold;\" href=\"https:\/\/www.kaldorcentre.unsw.edu.au\/sites\/kaldorcentre.unsw.edu.au\/files\/Policy_Brief_11_Offshore_Processing.pdf\">jurisdiction and<\/a>\u00a0<a style=\"text-align: var(--text-align); background-color: #fafafa; box-sizing: inherit; text-decoration-line: underline; color: #000000; transition: color 0.3s ease-in-out 0s; text-decoration-skip-ink: auto; font-weight: bold;\" href=\"https:\/\/www.kaldorcentre.unsw.edu.au\/sites\/kaldorcentre.unsw.edu.au\/files\/Policy_Brief_11_Offshore_Processing.pdf\">responsibility<\/a><span style=\"font-weight: var( --e-global-typography-text-font-weight ); text-align: var(--text-align);\">, making it more difficult for people to access justice when their rights are violated. Persistent human rights abuses arise as a result, including the imposition of\u00a0<a style=\"box-sizing: inherit; text-decoration-line: underline; color: #000000; transition: color 0.3s ease-in-out 0s; text-decoration-skip-ink: auto; font-weight: bold;\" href=\"https:\/\/www.hrw.org\/news\/2023\/12\/20\/what-happened-here-should-have-been-warning-not-inspiration\">conditions amounting to inhumane and degrading treatment<\/a>, neglect, a lack of access to legal aid, lack of identification of and support for specific needs, and family separation. This should have served as a warning.<\/p><p style=\"box-sizing: inherit; margin: 24px 0px 0px; padding: 0px; overflow-wrap: break-word; color: #000000; font-family: 'Amnesty Trade Gothic', sans-serif;\">But more recent attempts \u2013 such as the\u00a0<a style=\"box-sizing: inherit; text-decoration-line: underline; color: #000000; transition: color 0.3s ease-in-out 0s; text-decoration-skip-ink: auto; font-weight: bold;\" href=\"https:\/\/eur01.safelinks.protection.outlook.com\/?url=https%3A%2F%2Fwww.amnesty.org.uk%2Ffiles%2F2024-02%2FAIUK%2520Asylum%2520policy%2520briefing%2520update%252029%2520Feb.pdf%3FVersionId%3DRUT.dxcKYoqNjJxymgs3aAHGozOUruIb&amp;data=05%7C02%7Cstephanie.pope%40oxfam.org%7C83453f7e1d2e441e0d6d08dc84ad500c%7Cc42c6655bda0417590bab6e48cacd561%7C0%7C0%7C638531128869255147%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C0%7C%7C%7C&amp;sdata=0DhDfTfyIWzJmw2N9LLckPbIxmKJQbhKMBl7UoN%2FKE8%3D&amp;reserved=0\">UK-Rwand<\/a><a style=\"box-sizing: inherit; text-decoration-line: underline; color: #000000; transition: color 0.3s ease-in-out 0s; text-decoration-skip-ink: auto; font-weight: bold;\" href=\"https:\/\/www.amnesty.org.uk\/files\/2024-02\/AIUK%20Asylum%20policy%20briefing%20update%2029%20Feb.pdf?VersionId=RUT.dxcKYoqNjJxymgs3aAHGozOUruIb\">a<\/a>\u00a0asylum scheme, which is not yet in effect following the\u00a0<a style=\"box-sizing: inherit; text-decoration-line: underline; color: #000000; transition: color 0.3s ease-in-out 0s; text-decoration-skip-ink: auto; font-weight: bold;\" href=\"https:\/\/www.hrw.org\/news\/2024\/01\/30\/uk-should-abandon-dangerous-authoritarian-rwanda-bill\">UK Supreme Court declaring it unlawful\u00a0<\/a>and in any event is unlikely to be operationalised at any significant scale \u2013 have already led to people being placed in detention and in a damaging legal limbo under threat of removal. Sending asylum seekers to Rwanda and other third countries breaches arrival countries\u2019 obligations under\u00a0<a style=\"box-sizing: inherit; text-decoration-line: underline; color: #000000; transition: color 0.3s ease-in-out 0s; text-decoration-skip-ink: auto; font-weight: bold;\" href=\"https:\/\/www.hrw.org\/news\/2024\/04\/23\/uks-harmful-rwanda-bill-become-law\">international refugee norms<\/a>, and undermines their commitment to the rule of law.<\/p><p style=\"box-sizing: inherit; margin: 24px 0px 0px; padding: 0px; overflow-wrap: break-word; color: #000000; font-family: 'Amnesty Trade Gothic', sans-serif;\">The EU and Member States\u2019 false promises of ensuring compliance with fundamental rights in the context of externalisation arrangements are no more than empty words. As the extensive track record of human rights violations in partner countries such as\u00a0<a style=\"box-sizing: inherit; text-decoration-line: underline; color: #000000; transition: color 0.3s ease-in-out 0s; text-decoration-skip-ink: auto; font-weight: bold;\" href=\"https:\/\/www.amnesty.org\/en\/documents\/mde19\/4439\/2021\/en\/\">Libya\u00a0<\/a>demonstrates, the EU and Member States have no adequate tools and competencies to effectively monitor or enforce human rights standards outside of EU territory.<\/p><p style=\"box-sizing: inherit; margin: 24px 0px 0px; padding: 0px; overflow-wrap: break-word; color: #000000; font-family: 'Amnesty Trade Gothic', sans-serif;\">Beyond the dire human cost, these arrangements also have a ruinous impact on the administration and cost of asylum systems, with the UK\u2019s attempts to forcibly remove people to Rwanda being\u00a0<a style=\"box-sizing: inherit; text-decoration-line: underline; color: #000000; transition: color 0.3s ease-in-out 0s; text-decoration-skip-ink: auto; font-weight: bold;\" href=\"https:\/\/eur01.safelinks.protection.outlook.com\/?url=https%3A%2F%2Fwww.theguardian.com%2Fuk-news%2F2024%2Fmar%2F01%2Frwanda-plan-uk-asylum-seeker-cost-figures&amp;data=05%7C02%7Cstephanie.pope%40oxfam.org%7C83453f7e1d2e441e0d6d08dc84ad500c%7Cc42c6655bda0417590bab6e48cacd561%7C0%7C0%7C638531128869270476%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C0%7C%7C%7C&amp;sdata=tRTuLoGWQrv1kiSxrEoxnSee%2F63g2g8db0vituMius0%3D&amp;reserved=0\">projec<\/a><a style=\"box-sizing: inherit; text-decoration-line: underline; color: #000000; transition: color 0.3s ease-in-out 0s; text-decoration-skip-ink: auto; font-weight: bold;\" href=\"https:\/\/www.theguardian.com\/uk-news\/2024\/mar\/01\/rwanda-plan-uk-asylum-seeker-cost-figures\">ted<\/a>\u00a0to cost a staggering \u00a31.8 million per asylum seeker returned. This is not only an unjustifiable waste of public money, but also a lost opportunity to spend it in ways that would truly aid people seeking asylum by investing in fair and humane asylum systems and the communities that welcome them.<\/p><p style=\"box-sizing: inherit; margin: 24px 0px 0px; padding: 0px; overflow-wrap: break-word; color: #000000; font-family: 'Amnesty Trade Gothic', sans-serif;\"><span style=\"box-sizing: inherit; font-weight: bolder;\">Ripple effects of evading responsibility<\/span><\/p><p style=\"box-sizing: inherit; margin: 24px 0px 0px; padding: 0px; overflow-wrap: break-word; color: #000000; font-family: 'Amnesty Trade Gothic', sans-serif;\">The political feasibility of externalisation arrangements has also been heavily contested, given third countries\u2019 reluctance to take on responsibility for asylum seekers or refugees that Europe refuses to welcome. The outsourcing of asylum processing and refugee protection sends a dangerous signal to countries in the global South on EU countries\u2019 refusal to uphold their responsibilities towards refugees and do their fair share. Far from showing international solidarity, the EU is attempting to further push its responsibilities onto countries who already host the majority of refugees with often far fewer resources \u2013 a policy that is not necessarily conducive to building global influence, the European Commission\u2019s\u00a0<a style=\"box-sizing: inherit; text-decoration-line: underline; color: #000000; transition: color 0.3s ease-in-out 0s; text-decoration-skip-ink: auto; font-weight: bold;\" href=\"https:\/\/www.politico.eu\/wp-content\/uploads\/2024\/04\/18\/draft-IntPa-briefing-for-next-Com-April-2024-1-cleaned.pdf\">stated aim<\/a>. Simultaneously, the bloc is reducing the non-migration-related support it offers partner countries, by\u00a0<a style=\"box-sizing: inherit; text-decoration-line: underline; color: #000000; transition: color 0.3s ease-in-out 0s; text-decoration-skip-ink: auto; font-weight: bold;\" href=\"https:\/\/policy-practice.oxfam.org\/resources\/from-development-to-deterrence-migration-spending-under-the-eu-neighbourhood-de-621536\/\">redirecting<\/a>\u00a0already scarce aid to<br style=\"box-sizing: inherit;\" \/>efforts to prevent migration, and spending large shares of development aid on domestic programmes. Almost\u00a0<a style=\"box-sizing: inherit; text-decoration-line: underline; color: #000000; transition: color 0.3s ease-in-out 0s; text-decoration-skip-ink: auto; font-weight: bold;\" href=\"https:\/\/www.oecd.org\/dac\/ODA-summary-2023.pdf\">17%<\/a>\u00a0of EU Development Assistance Committee (DAC) members\u2019 Official Development Assistance (ODA) is allocated to in-donor refugee costs, meaning it never leaves their territories.\u00a0<a style=\"box-sizing: inherit; text-decoration-line: underline; color: #000000; transition: color 0.3s ease-in-out 0s; text-decoration-skip-ink: auto; font-weight: bold;\" href=\"https:\/\/www.caritas.eu\/wp-content\/uploads\/2024\/01\/Joint-letter_GSP-reform_readmission-conditionality_Feb-2023.pdf\">Trade<\/a>\u00a0or visa relations have also become bargaining chips in controversial deals with non-EU countries to press them to fulfil the EU\u2019s domestic migration objectives.<\/p><p style=\"box-sizing: inherit; margin: 24px 0px 0px; padding: 0px; overflow-wrap: break-word; color: #000000; font-family: 'Amnesty Trade Gothic', sans-serif;\">This lack of commitment to responsibility sharing, international treaties and the global refugee protection system is<a style=\"box-sizing: inherit; text-decoration-line: underline; color: #000000; transition: color 0.3s ease-in-out 0s; text-decoration-skip-ink: auto; font-weight: bold;\" href=\"https:\/\/www.hrw.org\/news\/2024\/01\/30\/uk-should-abandon-dangerous-authoritarian-rwanda-bill\">\u00a0not lost on partner countries<\/a>, and risks\u00a0<a style=\"box-sizing: inherit; text-decoration-line: underline; color: #000000; transition: color 0.3s ease-in-out 0s; text-decoration-skip-ink: auto; font-weight: bold;\" href=\"https:\/\/www.independent.co.uk\/voices\/as-the-kenyan-minister-for-national-security-here-s-why-i-m-shutting-the-world-s-biggest-refugee-camp-a7020891.html\">undermining<\/a>\u00a0their willingness to provide protection: why would other major refugee hosting countries be incentivised to take on the EU\u2019s responsibility for refugee protection, when the EU itself refuses to uphold the right to seek asylum on its territory? The potential ripple effect could be devastating for refugee protection globally.<\/p><p style=\"box-sizing: inherit; margin: 24px 0px 0px; padding: 0px; overflow-wrap: break-word; color: #000000; font-family: 'Amnesty Trade Gothic', sans-serif;\"><a style=\"box-sizing: inherit; text-decoration-line: underline; color: #000000; transition: color 0.3s ease-in-out 0s; text-decoration-skip-ink: auto; font-weight: bold;\" href=\"https:\/\/www.hrw.org\/news\/2024\/04\/15\/civil-society-organisations-call-meps-vote-down-harmful-eu-migration-pact\">Civil society organisations\u00a0<\/a>have been\u00a0<a style=\"box-sizing: inherit; text-decoration-line: underline; color: #000000; transition: color 0.3s ease-in-out 0s; text-decoration-skip-ink: auto; font-weight: bold;\" href=\"https:\/\/www.hrw.org\/news\/2023\/12\/21\/eus-migration-pact-disaster-migrants-and-asylum-seekers\">clear about<\/a>\u00a0their\u00a0<a style=\"box-sizing: inherit; text-decoration-line: underline; color: #000000; transition: color 0.3s ease-in-out 0s; text-decoration-skip-ink: auto; font-weight: bold;\" href=\"https:\/\/www.amnesty.org\/en\/latest\/news\/2024\/04\/eu-migration-asylum-pact-put-people-at-risk-human-rights-violations\/\">serious concerns<\/a>\u00a0with regards to the recently agreed reforms under the Pact on Migration and Asylum. Nonetheless, the transfer of asylum seekers outside of EU territory for asylum processing and refugee protection is not provided for in the Pact, nor within current EU law. After the EU and Member States have spent close to a decade attempting to reform the EU\u2019s asylum system, they should now focus on implementing it with a human rights centred approach that prioritises the right to asylum per EU law and fundamental principles of international refugee law to which they remain bound.
