What does the report reveal?<span data-ccp-props=\"{}\">\u00a0<\/span><\/h6><p><span data-contrast=\"auto\">\u00bbThe report\u00a0documents that approximately 1,700 Ukrainian prisoners were deported by Russian occupying forces to prisons inside the Russian Federation in November 2022, following the full-scale invasion of Ukraine. These individuals had been serving custodial sentences in Ukrainian penitentiary facilities that fell under Russian control after February 2022. Based on testimonies from 233 current or former prisoners, the report traces the full arc of this deportation process from\u00a0initial\u00a0forced transfers through transit centres in occupied Crimea, to prolonged detention in penitentiary facilities inside Russian territory.\u00a0The deportations were carried out under conditions that fell far short of international standards\u00ab.\u00a0<\/span><span data-ccp-props=\"{&quot;335559738&quot;:240,&quot;335559739&quot;:240}\">\u00a0<\/span><\/p><h6>How?\u00a0\u00a0<\/h6><p><span data-contrast=\"auto\">\u00bbPrisoners were transported at gunpoint in overcrowded vehicles for up to 12 hours, sometimes alongside individuals with tuberculosis, and without adequate food, water, or sanitation. They\u00a0were required\u00a0to abandon personal belongings, including medication, prior to transfer. The report concludes that these transfers lacked any legal justification under international humanitarian law, as there were no grounds of military necessity or population security that could\u00a0warrant\u00a0the removal of protected persons from occupied territory\u00ab.<\/span><span data-ccp-props=\"{&quot;335559738&quot;:240,&quot;335559739&quot;:240}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">\u00bbThe report further\u00a0identifies\u00a0a consistent pattern of physical and psychological ill-treatment throughout the deportation and\u00a0subsequent\u00a0detention.\u00a095%\u00a0of interviewees reported experiencing or\u00a0witnessing\u00a0abuse, including beatings, prolonged stress positions, and threats of violence \u2014\u00a0frequently\u00a0directed at prisoners\u00a0because\u00a0of\u00a0their Ukrainian nationality or perceived support for Ukraine.\u00a0Additionally, many prisoners were pressured to accept Russian citizenship during their detention, raising serious concerns about coercion and the erosion of their legal status as Ukrainian nationals. The report also documents serious violations during detention in the Russian Federation, including arbitrary detention, forced labour, and the systematic denial of contact with their families\u00ab.<\/span><span data-ccp-props=\"{&quot;335559738&quot;:240,&quot;335559739&quot;:240}\">\u00a0<\/span><\/p><h6 aria-level=\"2\">One of the report\u2019s conclusions is that the deportations\u00a0likely constitute\u00a0the war crime of unlawful deportation. How did the report reach that conclusion?\u00a0<\/h6><p><span data-contrast=\"auto\">\u00bbThe deportations of Ukrainian prisoners, culminating in November 2022, took place in the context of an international armed conflict between Russia and Ukraine, as well as a situation of occupation by Russia of parts of Ukrainian territory. In such circumstances,\u00a0international\u00a0humanitarian\u00a0law (IHL) governs the conduct of the parties involved. IHL establishes clear protections for civilians, including prohibitions on unlawful transfer, deportation, and inhumane treatment.\u00a0While IHL\u00a0permits\u00a0evacuation in limited circumstances \u2013\u00a0for the security of the population or imperative military reasons \u2013 such measures must be strictly necessary, temporary, and\u00a0conducted\u00a0under humane conditions\u00ab.<\/span><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">\u00bbAs\u00a0set out\u00a0in the report,\u00a0those deported\u00a0were civilians serving custodial sentences in Ukraine\u00a0at the time of the\u00a0Russian Federation\u2019s\u00a0invasion\u00a0on 24 February 2022\u00a0and\u00a0the ensuing\u00a0occupation.\u00a0They\u00a0were therefore entitled\u00a0as civilians\u00a0to protections under\u00a0IHL.\u00a0The deportations at issue satisfy none of the criteria\u00a0permitting\u00a0lawful evacuation.\u00a0Ukrainian prisoners were forcibly\u00a0transferred\u00a0by Russian\u00a0occupying forces and authorities\u00a0to the Russian Federation, with the\u00a0assistance\u00a0of Ukrainian prison staff who agreed to remain and work under Russian occupation.\u00a0The transfers do not appear to have been undertaken for legitimate evacuation purposes.\u00a0They\u00a0were\u00a0further\u00a0not intended to be temporary\u00a0as\u00a0evidenced\u00a0by the repeated offers of, and\u00a0in\u00a0many cases pressure,\u00a0to accept Russian citizenship\u00ab.\u00a0<\/span><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">\u00bbEven if framed as evacuations, the deportations were carried out in grossly inhumane conditions\u00ab.\u00a0<\/span><span data-ccp-props=\"{&quot;134233117&quot;:false,&quot;134233118&quot;:false,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559738&quot;:240,&quot;335559739&quot;:240}\">\u00a0<\/span><\/p><h6>What conditions were prisoners subjected to during the deportations?\u00a0<\/h6><p><span data-contrast=\"auto\">\u00bbPrisoners were forced to abandon personal belongings, including vital medication, and were transported in overcrowded vehicles, sometimes alongside prisoners with tuberculosis, without sufficient food, water, sanitation,\u00a0ventilation\u00a0or medical care.\u00a0<\/span><span data-contrast=\"auto\">Moreover, ill-treatment, and in several instances torture, was pervasive at every stage of the deportation process. It included beatings, prolonged periods in stress positions, intimidation, humiliation, and threats of physical or sexual violence, often on account of prisoners\u2019 nationality and their actual or assumed support for\u00a0Ukraine\u00ab.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:false,&quot;134233118&quot;:false,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559738&quot;:240,&quot;335559739&quot;:240}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">\u00bbLikewise, the return of Ukrainian prisoners grossly\u00a0failed to\u00a0meet the standards required under international humanitarian law. Upon release, many were abandoned on Russian territory or expelled to third countries \u2013 oftentimes without documents or means to return home. Others were\u00a0immediately\u00a0arrested for\u00a0alleged\u00a0illegally entering Russia,\u00a0despite having been forcibly brought there,\u00a0and detained in migration centres. Others still were transferred to prisons in Russian-occupied Crimea, where they faced further ill-treatment and\u00a0inhumane conditions. In all cases, their release exposed them to\u00a0additional\u00a0hardship, uncertainty, and mistreatment \u2013 reflecting a continued disregard for their rights as protected persons under international humanitarian law\u00ab.<\/span><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">\u00bbAccordingly,\u00a0this\u00a0conduct\u00a0constitutes\u00a0grave breaches\u00a0of\u00a0international\u00a0humanitarian\u00a0law and\u00a0likely amounts\u00a0to\u00a0war crimes, giving\u00a0rise to individual criminal responsibility under international law, as reflected in the Geneva Conventions and the Rome Statute of the International Criminal\u00a0Court.\u00ab<\/span><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6}\">\u00a0<\/span><\/p><h6 aria-level=\"2\">Why could it also be a crime against humanity?\u00a0<span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559685&quot;:0,&quot;335559991&quot;:360}\">\u00a0<\/span><\/h6><p><span data-contrast=\"auto\">\u00bbThe same conduct may also qualify as a crime against humanity under\u00a0International criminal law.\u00a0Unlike war crimes, which are tied to the existence of an armed conflict, crimes against humanity focus on the scale and organised nature of the conduct.\u00a0Under the Rome Statute of the International Criminal Court, crimes against humanity include deportation or forcible transfer of population, torture, persecution, and other inhumane acts,\u00a0but only when carried out as part of a widespread or systematic attack directed against a civilian population, pursuant to a state or organisational policy\u00ab.<\/span><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">\u00bbThe deportations and pervasive ill-treatment documented in this report may meet this threshold.\u00a0The widespread nature of the conduct is reflected in the\u00a0large number\u00a0of Ukrainian prisoners affected and their transfer across multiple locations before ultimate deportation to the Russian Federation. The systematic nature is\u00a0indicated\u00a0by the structured and coordinated\u00a0manner in which\u00a0Russian occupying forces and authorities carried out these operations, with ill-treatment recurring consistently at each stage. Taken together, these features point to an organised pattern of conduct rather than isolated incidents\u00ab.<\/span><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6}\">\u00a0<\/span><\/p><p><span data-contrast=\"auto\">\u00bbThis pattern does not appear to have been accidental. As documented by UN bodies and non-governmental organisations,\u00a0the deportation and forced transfer of Ukrainian civilians \u2013 including children \u2013 has been a recurring practice in territories under Russian occupation, linked to efforts to\u00a0consolidate\u00a0control over\u00a0Ukrainian territory and\u00a0the civilian population. Under international criminal law, a state or organisational policy need not be formally declared; it can be inferred from a consistent and repeated pattern of conduct. The scale, geographic spread, coordinated procedures, and recurring ill-treatment documented in this report support such an inference, and may satisfy the requirements for crimes against humanity under the Rome Statute of the International Criminal Court.<\/span><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6}\">\u00a0<\/span><\/p><h6 aria-level=\"2\">What has happened to the deported prisoners since their release?\u00a0\u00a0<\/h6><p><span data-contrast=\"auto\">After their release from prisons in the Russian Federation and\/or Occupied Crimea,\u00a0some of the former prisoners returned to Ukraine via the third countries (for instance, Georgia,\u00a0Turkey, Moldova) with the\u00a0assistance\u00a0of\u00a0volunteers,\u00a0civil society members, and\u00a0relatives. In some cases, Russian prison authorities provided them with small\u00a0amount of money,\u00a0in average,\u00a0from 800 to\u00a05000\u00a0Russian rubbles (approximately 10-50\u00a0Euro), however, this amount was not sufficient to\u00a0get to Ukraine. In many cases, released prisoners lacked identification documents.\u00a064\u00a0people, after release from Russian prisons, were immediately apprehended by the Russian police, took to courts where they were sentenced for illegal crossing of the Russian border, and\u00a0placed into centres for illegal migrants where they were detained for the period from several weeks to several months, after which they were expelled from the Russian\u00a0Federation to Georgia.\u00a0\u00a0<\/span><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6}\">\u00a0<\/span><\/p><h6 aria-level=\"2\">How did DIGNITY work with Ukrainian partners to document the deportations in this report, and how does this cooperation support documentation of violations more broadly?\u00a0<\/h6><p><span data-contrast=\"auto\">\u00bbFor this report, DIGNITY\u2019s Ukrainian partners conducted interviews with direct victims of deportation using\u00a0a methodology\u00a0developed by DIGNITY and a survivor-centred,\u00a0trauma-informed approach,\u00a0which\u00a0involved\u00a0participation of a psychologist in\u00a0witness interviews and referral for external\u00a0psychological\u00a0assistance\u00a0if needed.\u00a0DIGNITY and its Ukrainian partners also reviewed documentary evidence, including Russian court decisions, reports by international organisations and media\u00a0reports. More\u00a0broadly, DIGNITY provides methodological support to its Ukrainian partners through capacity-building activities, including training, workshops, peer review of witness statements, the development of guidelines and questionnaires, and the establishment of databases for storing collected\u00a0evidence.\u00a0Through\u00a0the project, partners can also refer victims and witnesses to professional psychological support when needed\u00ab.<\/span><span data-ccp-props=\"{&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559685&quot;:0,&quot;335559991&quot;:0}\">\u00a0<\/span><\/p><h6 aria-level=\"2\">How can this report contribute to accountability?\u00a0\u00a0<\/h6><p><span data-contrast=\"auto\">\u00bbThis report contributes to accountability in several ways. It documents the deportations, detention conditions, and patterns of ill-treatment suffered by Ukrainian prisoners. It links these facts to relevant standards under international criminal law \u2013 helping support their qualification as potential war crimes and crimes against humanity under the Rome Statute of the International Criminal Court.
